We’ve all seen the commercials and billboards. But, is it that simple? The answer is no! Actually, there is nothing simple about DWI. What the billboards don’t tell you is that it is not illegal to drink then drive if you are at least 21 years of age. The fact of the matter is that it's only illegal to operate a motor vehicle if you are legally intoxicated.

And, it's the State's burden to prove, beyond all reasonable doubt, that you were physically or mentally impaired, because of alcohol or drugs, at the time you were driving. Or, the State has to prove that your BAC was .08 or greater at the time you were operating your vehicle.
